First Sale Doctrine before the Supreme Court

On October 29th the Supreme Court will hear arguments in Kirtsaeng v. Wiley a case where the justices are being asked to determine the geographic scope of the First Sale Doctrine which could have a wide range of implications – most of them bad. ARL will be hosting a free webcast on the case on October 16th from 1:00 to 2:00  p.m. The panel will include Johanthan Band, Carrie Russell, and Kevin Smith and be moderated by Brandon Butler. The last time the Supreme Court visited the First Sale Doctrine was 2010 in Costco Wholesale Corp. v. Omega S.A.  This time around will give the Court the opportunity to clarify questions that were not answered in the Costco litigation.
